Terms and Conditions
1. PRICE AND PAYMENT
1.1 Validity Period is 10 Days
1.2 5% Vat Applicable
1.3 Our offer includes custom clearance and local charges in UAE only.
1.4 Quoted Price cover transport and delivery within UAE.
1.5 Unless otherwise agreed in writing, a deposit of Seventy percent (70%) Non-Refundable advance payment shall be made on all furniture, carpets or joinery orders with the Thirty percent (30%) balance due 10 working days prior to the delivery of the Goods.
1.6 If the outstanding balance of payment is not received by the due date, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE reserves the right to delay delivery until full payment is made. If payment is not made in cleared funds within ten (10) working days from the due date, ZUMA DESIGN FZ LLC reserves the right to cancel all orders and retain any and all deposits paid.
1.7 100% payment is required for Showroom stocks; or 50% advance for reservation and 50% balance a week before delivery.
1.8 Our prices may change at any time, however all orders which have been confirmed by payment of minimum 50% deposit will not be variable.
1.9 All goods remain the property of ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE until full payment has been recieved. As a consequence, in the event of the purchaser failing to pay the seller, the latter expressly reserves the right to retain the goods.
1.10 If the client chooses to make the payment via bank transfer, any associated bank charges or deductions shall be borne by the client.
1.11 For all customized or made-to-order items with a total order value of AED 10,000 or below, the Client is required to remit full payment (100%) at the time of order confirmation. Production, procurement, and customization activities will be scheduled to commence upon receipt of the full payment amount.
2. EXCHANGES AND RETURNS
2.1 Subject to condition 2.3 below, no cash or credit refunds shall be made once an invoice or deposit receipt is generated.
2.2 Subject to condition 2.3 below, no exchange, refund or credit note will be accepted on special orders, goods purchased at a discount, accessories, fabric, carpet or wallpaper orders, furniture already assembled, upholstered furniture and/or used bed and bath products or any products damaged due to customer misuse.
2.3 Refunds will only be provided for defective goods if repair or replacement options are unavailable. Repair or exchange of the goods is limited to defects that are caused by misuse or failure to follow care instructions such returns must be accompanied by proof of purchase. Any returned items should be in their original packing and be accompanied by the original bill/receipt.
2.4 The sample deposit will be refunded only upon the return of the borrowed samples in good condition. If the samples are returned with any damage, including spots, stains, or loss of threads, the refund will not be applicable.
2.5 The Client should inform ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE in writing within 7 Days if any manufacturing defect found after delivery and ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will not accept any complaints reported after the mentioned days.
3. CANCELLATION
3.1 Once the ordered carpet has entered the production process, the order becomes non-cancellable.
3.2 In the event of a cancellation under any circumstances, refunds are not available. Instead, a credit note will be issued, valid for 6 months, which can be used toward future purchases from Zuma.
3.3 All cancellation requests must be submitted to us in writing. If the product has not yet entered production, a 20% cancellation fee will be applied to the total invoice amount to cover design and administrative costs.
4. CREDIT NOTE
4.1 Credit notes are valid for six (6) months from date of issue.
4.2 Original credit note must be produced at the time of redemption.
4.3 Credit notes may only be redeemed at the issuing store and may not be used during sale or promotion periods.
4.4 Credit notes are non-refundable and non-transferable.
4.5 ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE reserves the right to issue credit notes for all valid returns, as per conditions 2.3 above.
5. RESERVATION AND STORAGE
5.1 Twenty-four (24) hours allowed to reserve the items and beyond twenty-four hours 50% advance is required and considered sold once advance paid.
5.2 Goods will be stored free of charge for one week. After this time, charges of AED 15 per CBM Cubic Meter Space Occupied per Day will be applied. Delivery will not take place until the storage charges have been paid in full.
6. CUSTOMIZATIONS AND MODIFICATIONS
6.1 The customer may request a modification to their order by sending the request in writing prior to the goods entering production.
6.2 Once the order placed by customer; cannot be modified, exchanged, returned or refunded.
6.3 For furniture requires “customers own fabric/leather", the client needs to send us A4 paper size sample material for approval.
6.4 The production for furniture with "customers own fabric/leather" will commence only after the materials supplied by the client reaches the factory.
6.5 Color shade of yarn, fabrics, leather and wood of same product may have slight variations from batch to batch. Colors may also change with age and exposure to sun and other climatic conditions.
6.6 For Made to Measure Carpets or Furniture a rendering of the final designs will be submitted within 7 days of advance payment following which the production will commence as per the rendering.
6.7 For On Site Installations of Carpets or Built in Furniture, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will have a team member coming for site inspection prior to production and installation. Subsurface Levelling, flat sceed, junction profiles and ambient external/internal air conditioning as well as other finishes to be as per requirements needed for subfurface finishing to be provided by client before installation.
7. HOME TRIAL CHARGES
7.1 Dubai, Sharjah, Ajman AED 1600 + VAT (Upto 5 pieces); AED 2,500 + VAT (Upto 10 pieces); AED 5,000 + VAT (Upto 20 pieces).
7.2 Abu Dhabi, Fujairah, Ras Al Khaimah, Umm Al Quwain, Al Ain, AED 2400 + VAT (Upto 5 Pieces); AED 3,500 + VAT (Upto 10 pieces); AED 6,000 + VAT (Upto 20 pieces).
7.3 Free Home Trial If Order Value Above AED 100,000 Project Advance Paid.
7.4 Once the goods have been delivered to the site, no exchange or refund will be allowed. The home trial fee is non-refundable and non-discountable, in case there is no purchase during the home trial.
8. SAMPLE CHARGES
8.1 From Store: AED 1200/Sample Deposit
8.2 Customized Hand Tufted Sample: AED 1200+400/Sample Delivery Charges.
8.3 Customized Hand Knotted Sample: AED 2500+400/Sample Delivery Charges.
8.4 1 Sample is Free For Order Value Above AED 50,000 Project Advance Paid; Freight to be Paid and Billed to Clients AED 400/Sample Delivery Charges, AED 500 delivery charges per sample if sample delivered outside the UAE.
8.5 Customized natural silk, delicate silk, spun silk and ultra premium wool sample charges are AED 3750+400 Delivery charges per sample.
9. SHIPPING, DELIVERY AND INSTALLATION
9.1 Upon placement of order, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE shall give you an estimated delivery date for your goods, which shall be offered as guidance only.
9.2 Surcharge will be applied for furniture/carpets to be transported via air freight or courier.
9.3 When your goods are ready for delivery, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will contact you to agree a delivery date on the contact details provided. Once a delivery date has been agreed you will be responsible for accepting the delivery and arranging appropriate means of access and installation on that date. It is your responsibility to ensure that ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE delivery team has access to the delivery address, and that sufficient space for the goods is available. Delivery on the first floor and above shall be achieved by service elevators arranged by you and it is your responsibility to notify ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE of any potential problems with access to the premises, building, service elevators etc., and make any related delivery arrangements. Where delivery is complicated by such factors, additional charges will be incurred by you.
9.4 It is the responsibility of the client to ensure adequate access to the delivery address. If on the delivery date ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE delivery team is unable to obtain access to the delivery address, you will incur a re-delivery charge of one percent (1%) of the purchase price, which must be paid prior to re-delivery.
9.5 If you fail to agree a revised delivery date within thirty (30) days of ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE delivery request, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE retains the right to cancel your order, retain all amount paid and re-sell the goods with no further liability.
9.6 ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE team will not disassemble, pack or shift furniture existing in client’s premise. Client needs to make arrangement to clear any existing furniture.
9.7 ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will not be responsible for any potential delivery problems including vehicle access to site, narrow stairs and doors, small service lifts, low ceilings or any other barriers. Removal or avoiding of any barriers to make delivery possible is solely under client’s cost and risk.
9.8 If delivery is not accepted on the agreed delivery date, goods shall be kept in storage free of charge for a period of up to Seven (7) days. If you fail to agree a revised delivery date within thirty (30) days of ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE redelivery request, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE retains the right to cancel your order, retain all monies paid and re-sell the goods with no further liability.
9.9 ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE do not accept any responsibility for damage to client's property during delivery other than damage due to our negligence and our liability is limited to the repair of that damage.
9.10 Electrical installation will be quoted according to each individual project.
9.11 In the absence of negligence, ZUMA will not be liable for loss or damage to the goods or your property caused by (i) ZUMA following your instructions; (ii) limited or no access to the premises; and/or (iii) goods not fitting into your property.
9.12 For installations conducted outside the UAE, if the total installation amount is below AED 25,000, the customer agrees to pay an additional surcharge for the costs of the visa and air ticket for the installation personnel.
9.13 For deliveries outside the UAE, all arrangements related to labor, handling, and offloading of materials from the vehicle shall be the responsibility of the client.
10. STANDARD PRODUCTION AND DELIVERY TIME TO ZUMA WAREHOUSE IN DUBAI
10.1 8-12 Weeks for Hand Tufted Carpets.
10.2 8-14 Weeks for Hand Loom Carpets.
10.3 12-18 Weeks for Hand Knotted (Upto 144 Knots).

12. ACCEPTANCE
12.1 You or a Responsible person with appropriate ID acting on your behalf, will be asked to inspect the goods and sign the delivery document to acknowledge delivery and/or installation. Goods will not be released without signing the delivery documents acknowledging inspection of goods. You hereby agree to remain responsible in accordance with these Terms and Conditions notwithstanding that you may have nominated a third party to receive goods on your behalf Non-availability of the nominated personnel will result in delivery cancellation and re-delivery will be made with a surcharge. ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will notify the client in writing with regards to the surcharge involved.
12.2 Prior to signing the delivery note ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE requires the recipient to examine the goods carefully and report any error, damage or defect on the delivery documents. Only defects reported on the delivery documents will be acknowledged by ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE.
12.3 Any manufacturing defect must be notified to ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE. in writing within seven (7) days of receipt of goods.
13. UNAVOIDABLE DELAYS
13.1 ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will not be liable for any delay or failure in performing ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE obligations where the delay or failure results from any act, event or accident beyond ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE control, including but not limited to, war, terrorism, sabotage, civil or military disturbance, fire, explosion, storm, flood, earthquake or other natural disasters, strikes, lock-outs or import / export embargoes, or the impossibility of ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE using railways, shipping, aircraft, motor transport or other means of public or private transport. If such circumstances arise, ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE will use all reasonable efforts to notify you.
14. INTELLECTUAL PROPERTY RIGHTS
14.1 Any design services are chargeable of minimum AED 5,000 and may vary depends on the scope of work.
14.2 We will not release drawings and/or plans until we have received a confirmed order and relevant deposit or until the design fee has been paid in full. We retain the copyright, design rights and all other intellectual property rights of the goods, drafts, drawing and/or illustrations we make in connections with any design services.
15. WARRANTY
15.1 We guarantee that on delivery and for a period of 12 months from date of invoice, the goods shall be free from material defects.
15.2 Not withstanding our guarantee, there will be a call out fee of AED 350 + VAT, plus expenses and any costs of repair or replacement for repairing certain types of defect or any material defects reported after the date falling 12 months after the date of delivery.
15.3 We cannot accept the return of made-to-measure goods if incorrect measurements have been provided by the customer.
16. LEGAL EFFECT
16.1 Your signature on the sales order form receipt confirms that you have read, understood and agree to be bound by these Terms and Conditions.
16.2 If any part of these Terms and Conditions are found to be unenforceable, it will not affect the enforceability of the remainder of the terms, conditions and obligations of the parties
16.3 These Terms and Conditions shall be governed by the laws of Dubai/Sharjah in the United Arab Emirates.
16.4 These Terms and Conditions are personal to the individual customer and cannot be relied on by any third party.
16.5 These are ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE Terms and Condition and in the absence of express wording signed by both parties on the front of the sales order, these Terms and Conditions shall take precedence over all other terms and conditions.
16.6 Incase a customer has made an advance payment to ZUMA DESIGN FZ LLC/ZUMA INTERNATIONAL FZE without signature on the quote the above Terms and Conditions will automatically take into effect and govern the terms of the contract.
